NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two days after the date of issuance of this citation and petition, a default judgment may be taken against you.”

Defendant, Greeting:
You are hereby commanded to appear by filing a written answer to the PLAINTIFF’S ORIGINAL PETITION at or before ten o’clock a.m. on the Monday next after the expiration of forty-two days after the date of issuance of this citation, the same being: Monday the 10th day of AUGUST, 2026 before the Honorable 115th District Court of Upshur County, Texas at the Justice Center, located at 405 N. Titus St., of said County in Gilmer, Texas.

Said Plaintiff’s Petition was filed in said court on the 22ND day of JUNE, 2026, In this case numbered 26-230-DCCV-00249 on the docket of said court styled:

A brief statement of the nature of this suit is as follows, to wit: THIS PROCEEDING CONCERNS THE FORECLOSURE OF A LIEN ON THE FOLLOWING REAL PROPERTY AND IMPROVEMENTS COMMONLY KNOWN AS 299 ELM ROAD, GILMER, TEXAS 75645 AND MORE PARTICULARLY DESCRIBED AS:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND BEING ONE(1) ACRE LYING IN THE J.B.B. DAVENPORT GRANT, ABS. NO 1, UPSHUR COUNTY TEAS AND BEING OUT OF AN ORIGINAL 45 ACRE TRACT AS DEEDED TO C.E. LANGFORD BY MILDRED SPEIR EARLY, ET AL, AND BEING LOT 5 AS SHOWN BY PLAT OF LANGFORD ACRES, A SUBDIVISION IN SAID DAVENPORT SURVEY BY PLAT R.E. MCCLELLAND, REGISTERED PUBLIC SURVEYOR, DATED FEBRUARY 16, 1982, SAID LOT NO. 5 DESCRIBED AS FOLLOWS:

BEGINNING AT A STEEL STAKE ON THE EAST EDGE OF A PUBLIC ROAD OR STREET AT THE NWC OF THE BILLY D. MELTON HOME TRACT; THENCE NORTH 129.75 FEET WITH THE EAST SIDE OF SAID ROAD OR STREET TO A STEEL STAKE FOR CORNER; THENCE EAST 335.72 FEET TO A STEEL STAKE FOR CORNER; THENCE SOUTH 129.75 FEET TO A STEEL STAKE FOR CORNER; THENCE WEST 335.72 FEET TO THE PLACE OF BEGINNING, AND CONTAINING ONE ACRE OF LAND, MORE OR LESS. TAX ID: S242-S02-000-LT05.

as if more fully shown by Plaintiff’s Petition on file in this suit. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due return as the law directs.
