You are hereby commanded to appear by filing a written answer to the PLAINTIFF’S ORIGINAL PETITION FOR PARTITION OF REAL PROPERTY TO CHAPTER 23A OF THE TEXAS PROPERTY CODE at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation, the same being JULY 13th, 2026 before the Honorable Judge Dean Fowler, 115th District Court of Upshur County, at the Courthouse in said County in Gilmer, Texas. Said PLAINTIFF’S ORIGINAL PETITION FOR PARTITION OF REAL PROPERTY TO CHAPTER 23A OF THE TEXAS PROPERTY CODE was filed in said court on the 11TH day of May, 2026 in the above-entitled cause.
RICKEY WELLS, V. SASHA FORT, SHEENA FORT-SMITH, AND THE UNKNOWN HEIRS OF ROSLYN WELLS
A brief statement of the nature of this suit is as follows, to-wit: PLAINTIFF’S ORIGINAL PETITION FOR PARTITION OF REAL PROPERTY TO CHAPTER 23A OF THE TEXAS PROPERTY CODE.
This lawsuit seeks to partition real property located on Private Road 4214 in Gilmer, Upshur County, Texas. The Property is community property of Roslyn Wells and her husband, Rickey Wells. Roslyn died intestate on February 9, 2014. Upon Roslyn’s death, Rickey retained his 50% ownership interest in the Property and Roslyn’s 50% interest transferred to her children from a prior relationship. Rickey seeks Court intervention to partition the Property. Because of a unique circumstance, Rickey seeks both partition in kind and partition in sale, as set forth herein.
