You are hereby commanded to appear by filing a written answer to the Plaintiff’s SECOND AMENDED Original Petition at or before 10:00 o’clock a.m. on the Monday next after the expiration of 42 days after the date of issuance of this citation, the same being April 20th, 2026 before the Honorable Judge Dean Fowler, 115th District Court of Upshur County, at the Courthouse in said County in Gilmer, Texas. Said Plaintiff’s SECOND AMENDED Original Petition was filed in said court on the 27th day of February 2026 in the above-entitled cause.

CARROLL COMPANY, LLC, MASTEC UTILITY SERVICES, LLC, A1 EXCAVATING, MARVIN JEROME LAWRENCE, JR., DELORIS DIANN LAWRENCE, A KNOWN HEIR OF MARVIN JEROME LAWRENCE, JR., DECEASED, THE UNKNOWN HEIRS OF MARVIN JEROME LAWRENCE, JR., DECEASED, MASTEC NETWORK SOLUTIONS, LLC;
A brief statement of the nature of the suit is as follows, to wit: PLAINTIFF’S SECOND AMENDED ORIGINAL PETITION, INJURY/DAMAGE-MOTOR VEHICLE.
At approximately 12:00 p.m. on August 2, 2023, Plaintiff was traveling in a 2020 Mitsubishi Eclipse, northbound on North Cypress Street, stopped at a stop sign at the intersection with State Highway 155 North, in Gilmer, Upshur County, Texas. Marvin Jerome Lawrence, Jr., was operating a 2018 Ford F550 pickup truck owned and/or leased by Defendants, MASTEC IN., MASTEC NORTH AMERICA, INC., R.J,. CARROLL COMPANY, LLC, MASTEC UTILITY SERVICES, LLC, A1 EXCAVATING and/or MASTEC NETWORK SOLUTIONS LLCS, traveling northbound on North Cypress Street, and following behind Plaintiff, in Gilmer, Upshur County, Texas. After having initially stopped behind Plaintiff at the stop sign located at the intersection, suddenly without warning, Marvin Jerome Lawrence, Jr. moved his vehicle from a stopped position, failed to control speed of his vehicle, and struck Plaintiff’s vehicle, subjecting Plaintiff to tremendous force.
