NOTICE TO DEFENDANT: You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgement may be taken against you. In addition to filing a written answer with the Clerk, you may be required to make initial disclosures to the other party of this suit. Defendant, Greeting:
You are hereby commanded to appear by filing a written answer to the Plaintiff’s Original Petition at or before 10:00 o’clock a.m. on the Monday next after the expiration of 42 days after the date of issuance of this citation, before the Honorable Judge Dean Fowler, 115th District Court of Upshur County, at the Courthouse in said County in Gilmer, Texas. Said Plaintiff’s Petition was filed in said court on the 23rd day of October 2025 in the above-entitled cause.

A brief statement of the nature of the suit is as follows, to wit: PLAINTIFF’S ORIGINAL PETITION, INJURY/DAMAGE-MOTOR VEHICLE.

At approximately 8:03 a.m. on November 1, 2023, Plaintiff and the minor child BRY.M. (“the minor child”), were traveling in a 2020 Chevrolet Traverse, southbound in the 1000 block of South White Oak Road, approaching the intersection with U.S. Highway 80 East, White Oak, Gregg County, Texas. Defendant, AMBER MARIE DENNETT, was traveling in a 2023 Honda Accord owned and/or leased by Defendant, DEREK KYLE DENNETT, eastbound on U.S. Highway 80 East, approaching a red traffic light at the intersection with South White Oak Road, in White Oak, Gregg County, Texas. As Plaintiff and the minor child were traveling through the intersection on a green light, suddenly and without warning, Defendant, AMBER MARIE DENNETT, totally disregarded the red light located at the intersection and proceeded into the path of Plaintiff’s and the minor child’s vehicle, colliding with Plaintiff’s and minor child’s vehicle and subjecting Plaintiff and the minor child to tremendous force.
