THE CITY OF GILMER OF UPSHUR COUNTY, TEXAS ORDER PROHIBITING OUTDOOR BURNING

WHEREAS, THE City of Gilmer Fire Chief finds present circumstances in all or part of the incorporated areas of the City of Gilmer, create a public hazard that would be exacerbated by outdoor burning.

IT IS HEREBY ORDERED BY THE City of Gilmer Fire Chief that all outdoor burning is prohibited in the City of Gilmer for 90 days from the date of the entry of this Order, unless restriction is terminated earlier based on a determination made by the Texas A&M Forest Service. The Order by the Gilmer Fire Chief was executed on the 5th of August 2026 effective for 90 days from the date of said Order. This order may be extended by action of the City of Gilmer governing body. This order is adopted pursuant to City of Gilmer Ordinance Chapter 38 Article III. Section 38-63 and other applicable statues. This order does not prohibit outdoor burning activities related to public health and safety that are authorized by the Texas Commission on Environmental Quality for (1) firefighting training; (2) public utility, natural gas pipeline or mining operations; (3) planting or harvesting of agricultural crops; (4) burns that are conducted by a prescribed burn manager certified under TCEQ.
