Defendant, Greeting:
You are hereby commanded to appear by filing a written answer to the Plaintiff’s Original Petition at or before ten o’clock a.m. of the Monday next after the expiration of forty-two days after the date of issuance of this citation the same being: Monday, 24th day of March, 2025, before the Honorable 115th District Court of Upshur County, Texas at the Justice Center of said County in Gilmer, Texas located at 405 North Titus Street, Gilmer, Texas 75644.
A brief statement of the nature of the suit is as follows, to wit: PLAINTIFF’S ORIGINAL PETITION, INJURY/DAMAGE-MOTOR VEHICLE
At approximately 1:39 p.m. on January 16, 2025, Plaintiff was traveling in a 2024 Dodge Ram 1500 pickup truck, southbound on U.S. Highway 271, in Gilmer, Texas. Charles Warrick Johns was operating a 2025 Jeep Grand Cherokee owned and/or leased by Charles Warrick Johns, northbound on U.S. Highway 271, approaching Plaintiff’s vehicle, in Gilmer, Texas. As Charles Warrick Johns neared Plaintiff’s vehicle, suddenly and without warning, Charles Warrick Johns failed to control the speed of his vehicle, failed to control his vehicle, and crossed over into the southbound lanes of traffic, into the path of Plaintiff’s vehicle, colliding with Plaintiff’s vehicle and subjecting Plaintiff to tremendous force.
