Grand Jury returns 19 indictments

The Upshur County Grand Jury returned 19 indictments, four of them sealed, and no-billed two cases Thursday, said District Attorney Billy Byrd.

Defendants, charges and bonds in the open indictments were as follows, Byrd’s office reported:

• Kenneth Dale Waller Jr., 40, of Pittsburg, possession of a controlled substance (methadone) on Nov. 11, 2013, a state jail felony. Although Waller posted a $5,000 surety bond after his Nov. 11 arrest, he was jailed again Jan. 19 when a warrant charging him with violating parole was issued.

Waller, who has been arrested 28 times, is being held without bond in the Upshur County Jail on the warrant alleging parole violation, and his bail bondsman received a “release of surety” upon deciding to get off the $5,000 bond.

• Denny Scott Wortham, 43, of Big Sandy, possession of a controlled substance (methamphetamine), a state jail felony, on Feb. 23, $10,000 surety bond.

• Paige Marie Williamson, 19, of Hawkins, burglary of a habitation on March 11, a second-degree felony. She remained in county jail under $25,000 bond.

• Myles Garrett Wisenbaker, 23, of Longview, “(leaving the scene of) accident involving bodily injury,” a third-degree felony, on Jan. 20, $5,000 surety bond.

• Gwendolyn Monique Kennedy, 26, of Gilmer, who was separately indicted on charges of possession of a controlled substance (methamphetamine) and unauthorized use of a vehicle, both state jail felonies.

She is accused of committing both offenses Nov. 19, 2013. Bond was set at $10,000 on the drug charge, and $5,000 on the vehicular charge, but she was released to Gregg County authorities to face felony charges there, including aggravated robbery.

• LeAnn Waunell Ball, 23, of Winnie, possession of a controlled substance (methamphetamine), a state jail felony, on Feb. 27, $10,000 surety bond.

• Mary Ellen Clark, 57, of Gilmer, unlawful possession of firearm by felon, a third-degree felony, on Dec. 27, 2013, $15,000 surety bond.

• Christopher Lee Evans, 17, of Gilmer, burglary of a habitation, a second-degree felony, on March 11. He remained in county jail under $25,000 bond.

• Max Robert Trimmell, 19, of Lone Star, burglary of a habitation, a second-degree felony, on March 11. He also remained in county jail under $25,000 bond.

• Edgar E. Chavez, 27, of Gilmer, burglary of a building, a state jail felony, on Jan. 31, $10,000 surety bond.

• Karri L. Tyler, 31, of Longview, fraudulent use/possession of identifying information, a state jail felony, on Jan. 30, $5,000 surety bond.

• Damien Cornelius Sherow, 25, of Longview, separately indicted on “abandon or endangering a child,” a statejail felony, and evading arrest/detention with a vehicle, a third-degree felony, both on Feb. 3. He remained in Gregg County Jail in Longview.

• Wallace Dewayne Payne, 53, of Diana, theft of firearm, a state jail felony, on March 10, $5,000 surety bond.

The identity of anyone charged in the sealed indictments wasn’t released since no arrest had been made in those cases, Byrd said.

Those indictments included one each for theft of property of the value of $1,500 or more but less than $20,000, tampering with physical evidence, enticing a child, and evading arrest/detention with vehicle, his office said.

Nature of the no-billed cases wasn’t disclosed.
