Man goes to prison for manslaughter

Two motions to revoke probation and nine guilty pleas were heard Tuesday in 115th District Court in Gilmer, with Judge Lauren Parish presiding.

One motion to revoke probation was against Phillip Earl Joiner, 42, of Gilmer, for the offense of intoxication manslaughter, which occurred on Sept. 11, 2006. The charge is a second-degree felony, and Joiner received eight years in prison.

The case was prosecuted by Upshur County District Attorney Billy Byrd, with Matthew Patton as defense attorney.

The other motion to revoke was against Jerry Lee Summerville II, 25, Winona, for possession of a controlled substance-cocaine, a state jail felony. He received a year in a state jail.

Byrd prosecuted the case, and Charles Van Cleef was defense attorney.

Guilty pleas included:

• Brandon Cole Burkett, 19, Gladewater, aggravated sexual assault of a child, a first-degree felony. He received 10 years deferred adjudication probation, and was fined $500 and assessed $681 court costs. He also must register as a sex offender.

Assistant District Attorney Robert Cole Jr. prosecuted the case, and Van Cleef was defense attorney.

• Pablo Camilo-Ugarte, 23, Longview, evading arrest-detention with a vehicle, a state jail felony. He received a year in jail. Byrd was prosecutor and Matthew Patton was defense attorney.

• Bobby Brian Burnette, 41, Grand Prairie, driving while intoxicated, subsequent offense, a third-degree felony. He received eight years in prison.

Byrd was prosecutor and Van Cleef was defense attorney.

• Eric Lavon Quinn, 39, Gilmer, possession of a controlled substance-methamphetamine, a state jail felony. He received two years in a state jail, probated for four years, and a $750 fine, and was assessed $325 in court costs.

He was also ordered to perform 200 hours of community service.

Assistant District Attorney Edward Choy prosecuted the case, and Van Cleef was defense attorney.

• Jerry Russell Creswell, 40, Gilmer, hindering apprehension, a third-degree felony. He got two years in prison, probated for five years, and a $500 fine. He also was ordered to perform 250 hours of community service.

Cole was prosecutor, and Van Cleef was defense attorney.

• Barbara Ann Borens, 46, Gilmer, possession of a controlled substance-cocaine, a state jail felony. She received two years in a state jail, probated for five years, and a $1,000 fine. She was also ordered to do 250 hours of community service. Choy was prosecutor, and Barry Wallace was defense attorney.

• Dano Greg Young, 35, Ore City, evading arrest detention with vehicle, a state jail felony. He received 15 months in a state jail. Cole was prosecutor, and David Griffith was defense attorney.

• Amanada Michelle Gore, 27, Big Sandy, possession of a controlled substance-methamphetamine. Byrd was prosecutor, and John Moore was defense attorney.

• Waldof Lewis Manschester, 10, Big Sandy, indecent exposure, a class B misdemeanor. He received six months in the Upshur County Jail. Choy was prosecutor, and Moore was defense attorney.
